Online Terms of Sale and Website Use

The following agreement outlines the terms and conditions for goods and services sold by OZ Design E-Store Pty Ltd from ozdesignfurniture.com.au. By placing an order for goods and/or services you agree to these terms and conditions.  

Please ensure you have sufficient help/manpower to move and load items form the warehouse or store to, and into your vehicle. You must examine all goods prior to acceptance of the product in good condition upon collection. Any damages or faults, must be reported to the store or warehouse staff at the time of collection. Any damages or faults that are identified after customers transport goods, will not be covered or considered the liability of OZ Design Furniture.  

OZ Design Furniture is not responsible for any furniture items that do not fit into your vehicle, house, apartment, your lift leading to your property, stairways, corridors and doorways, and we will not refund or exchange if this occurs. Refer to our 'Fit guide’  

In stock items are held in our Fulfilment Centres/Warehouses. If you elect to collect from a store or local warehouse, we will need to ship the products there before you can collect. In stock goods could take up to 3 weeks to arrive at your elected collection location. You will be notified via email or phone once your order arrives to your elected store or warehouse for collection.  

Product on Backorder, Pre-Order or Made to Order: Please refer to the quoted approximate lead time for that product as a guide for when we will have the item(s) in stock to dispatch out to your elected store or warehouse. (This is on product pages near the ‘add to cart’ button). Once all products you have ordered are in our Fulfilment Centre, we usually dispatch to stores/warehouses within 2-3 business days. You may then need to await up to 3 weeks for the goods to arrive to the correct location for pick up. 

Our products come with guarantees that cannot be excluded under the consumer laws in Australia. You are entitled to have the item replaced or refunded for a major failure of the product. In addition, if there is a minor fault with the product you are entitled to have the product repaired within a reasonable time or have the goods replaced at the election of OZ Design Furniture. 

All rights, including copyright, in the content of the website pages are owned, licensed to or controlled for these purposes by OZ Design Furniture Pty Ltd. In accessing these web pages, you agree that you may only download the content for your own individual and non-commercial use.

You are not permitted to copy, broadcast, download, store (in any medium), transmit, show or play in public, adapt or change in any way the content of these OZ Design Furniture Pty Ltd website pages for any other purpose whatsoever without the prior written permission of OZ Design Furniture Pty Ltd.  

You must examine all goods prior to signing the acceptance of the product in good condition at the point of delivery. Any damages must be reported to the delivery/courier driver and recorded on any delivery sheet. OZ Design Furniture is not responsible for any damages that may occur, resulting from you not checking goods direct from the Store or Warehouse. If no-one is at home on the arranged delivery day at the time of the drivers' arrival, a second delivery fee will apply. Any reports of damages or faults upon delivery receipt, must be made strictly within 24 hours of arrival, in writing and accompanied by images of the product itself, consignment labels and the entirety of the internal and external packaging for consideration. Contact customer care here.

Courier Deliveries: Most courier services do not provide an option to book a specific delivery day or time and surcharges may apply if rescheduling is required. It is important to note these will most likely be delivered to your door by a single serviceman. Unpacking, rubbish removal and assembly is NOT included in this service. All parcels are shipped requiring a customer signature upon receipt. You may elect to mark your parcel for ‘Authority to Leave’ with the courier, however it is important to note any goods under these consignments will no longer be considered the responsibility of OZ Design Furniture or the consigned courier should they be lost, stolen or damaged upon arrival. 

Standard and Premium deliveries: We cannot give you exact delivery times on the delivery day; however we will endeavour to get there as close as possible to the 2-3 hour time window we quote the day before your delivery. If you wish to change the delivery day, please ensure that you notify us at least 24 hours prior to the scheduled delivery day. If you are purchasing large items (size) of furniture, please ensure that you know whether the items will permit the safe delivery of purchased furniture into your home. 

OZ Design Furniture is not responsible for any furniture items that do not fit into your vehicle, house, apartment, your lift leading to your property, stairways, corridors or doorways, and will not grant a refund or exchange if this occurs. Refer to our 'Fit guide’.

Please take special care when placing your delivery address onto your order, as incorrect addresses mean you may lose your courier order. If you require any address change, we do require the front and back of your photo identification in order to make any changes. 

Please take special care when loading your mobile phone number onto your order, as incorrect mobile phone numbers may mean you miss your delivery/pick up SMS notification and Standard/Premium delivery drivers contacting you upon approach. 

Our delivery driver/s will take the utmost care and responsibility when delivering your product into your home, however we are not responsible when there is a real risk that the goods and or your premises will be damaged due to poor accessibility. Our delivery driver/s will inform you on arrival should they decide this to be the case. The goods may then be left at the safest agreed point or you may decide to sign an indemnity (if offered) and waiver for any damage to product or premises as a result of our drivers being requested by you to attempt such a delivery.  

We reserve the right to amend these Terms & Conditions at any time without notice and your access to this website may be restricted or terminated at any time without notice. In the event that your access to this website is restricted or terminated, these Terms & Conditions still apply.

OZ Design Online shall have no liability to you for any failure to deliver goods you have ordered, delay in delivery or any damage or defect to goods delivered, that is caused by any event or circumstance beyond our reasonable control. We will contact you as soon as reasonably possible if such an event is made aware to us. 

We quote an approximate lead time for the receipt of your order into the Store or Warehouse elected. Unfortunately, circumstances may change beyond our control which may lead to a delay in your order being delivered on time.  

In order to ensure your online purchase and subsequent delivery runs as smoothly as possible we ask that you take the time to read the terms and conditions of sale when checking out online carefully. It is your responsibility to review at point of online checkout to ensure that all details are correct; this must include model, size, colour, price, quantity and any other special requirements. 

Should you have an issue with your product and need to report this matter to OZ Design Furniture we request that you contact customercare@ozdesignfurniture.com.au immediately. Our products are sold for domestic use only. Our site is only intended for use by people resident in Australia. At this time we do not accept international orders through our website. 

On occasion some pieces of indoor furniture and homewares may appear in an outdoor setting for lifestyle photography purposes. All interior furniture purchased is for interior use only. 

Any timber, marble or natural feature products are sold with the understanding that each piece will be unique with a variation of colour, mineral lines, knots and gum veins. Natural timbers and marbles are beautiful, unique and varied. Consistency is only achieved in man-made products. Should you receive the incorrect product entirely (deemed incorrect by our Customer Care team) this must be notified to us at the time of collection or delivery and rejected (not taken home or left in your home by delivery team) - at this time our team will arrange a replacement as soon as possible. Our furniture and homewares collections may be subject to a variance of up to 3% of that of the dimensions indicated.

All prices include GST (at the current rate in Australia) where applicable, however exclude delivery costs which will be added to the total amount during checkout.

We aim to ensure that the pricing of the goods and services shown on the website is correct at all times. On some occasions, the web pages may not always accurately reflect the correct details at the moment at which you place your order. OZ Design Online reserves the right to change prices without prior notice at any time prior to dispatch of your order should such an issue occur.  In the event that a pricing error occurs, OZ Design Furniture reserves the right to correct this at any time and update existing orders as required. 

We will ship your order once all items are in stock. We use various 3rd party transport and courier networks to offer the most competitive rate available and network for the type of goods. Expected delivery times vary between metro and rural areas. We usually dispatch your order within 5 business days of all items being in stock. Please allow 10 business for shipping/transport to metro areas and allow 14-20 business days for rural areas.

If we have insufficient stock to complete your order, the products will be placed on backorder. The backorder timeframe will be indicated online, noting that these are approximate and shipping delays could occur outside our control. In these instances we will endeavor to ensure customers are updated accordingly. 

We reserve the right to charge an administration fee, of 30% of the purchase total for a cancelled order after a payment is taken. Please note that after the dispatch of your goods we will not refund for a change of mind or incorrect choice and no refund or exchange will be entered into.

We collect and use your personal data in accordance with the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) and our Privacy Policy. Please take the time to read this Privacy Policy as it contains terms which apply to you. By using the OZ Design Online website you consent to such collection and processing and you warrant that all data provided by you is accurate.

All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and OZ Design Online will not be liable for any delay or non-delivery.  Fees may apply to some payment options, refer to Payments and Finance Options

OZ Design Furniture encourages customers to consider safe use and installation of all furniture, to suit your individual circumstances. It is important to consider the placement of any furniture or homewares items, particularly in relation to your personal circumstance as well as those of others living in or visiting your home, such as children or the elderly. 

Toppling furniture is a safety risk. Some products have wall anchor or fixings provided within the packaging, in these cases they MUST be fixed to the wall for safe use. For more information and government recommendations, please see this ‘Product Safety Guide’  

Goods must be collected/delivered within 14 days from the date of notification that they are available or within an agreed written time frame. If goods are not collected/delivered, a storage fee of $20 per week will apply for each consecutive week until such goods are collected/delivered. Payment of said storage fees will be payable prior to the release of your order. Failure to collect or organise delivery within 3 months of notification of order arrival will result in the Sales Order being cancelled and all monies paid being forfeited.

Your warranty period commences from the date of receipt of your goods. OZ Design Furniture will not be liable for freight or shipping expenses in relation to warranty claims. Goods are to be returned or exchanged at your nearest store only if/when approved by OZ Design Furniture Online. The warranty shall be considered void if (subject to Australian Consumer Law):    

a. It is normal wear and tear. See information on Product Care   

b. Product is used for Commercial, contract, rental trade, institutional or other non-residential use.  

c. Damage caused by improper cleaning, negligence, treatment of the product with chemical, exposure of the goods to direct sunlight, extreme heat, bright lights or similar conditions resulting in discolouration, or otherwise caused by your acts and/or omissions.  

d. Damage by corrosive materials, such as acids or solvents, or dyes, inks, paints, human or animal bodily fluids.  

e. Damage resulting from abnormal or improper use, abuse or acts of God.  

f. If the furniture is not used correctly for the purpose intended, e.g., sitting on sofa arms or standing/swinging on dining chairs.  

g. Damage incurred during handling and transportations of the product.  

h. Floor samples or sales made on an ‘as-is’ basis will have limited warranty, and the price, age and condition of product will be taken in consideration.

i. Repairs to a product are made or attempted by a service provider, other than one approved by OZ Design Furniture.

j. The warranty against defect is not transferrable. It is limited to the original purchaser specified in the original Sales Order.
